Terms of Service
Effective October 1, 2026
These terms cover the websites, web apps and CRM systems Foundry27 LLC (“we”) builds, and the hosting we provide. By accepting a quote or using our client portal, you agree to them. Your accepted quote spells out the specifics of your project; if it conflicts with these terms, the quote wins.
Quotes
Quotes describe the work, the price, and any deposit. A quote is valid for 30 days unless it says otherwise. Work beyond what the quote describes is quoted separately or billed at our hourly rate, and we’ll always ask before doing it.
Payment
- A deposit (shown on your quote) is due before work begins.
- The remaining balance is due when the project is delivered, per the invoice.
- Invoices are due within 14 days unless the invoice states otherwise.
- We may pause work or hosting on accounts more than 30 days past due, after giving notice by email.
Refunds and cancellations
- Deposits are fully refundable if you cancel before work starts. Once work has started, the deposit is non-refundable, since it covers time we’ve already scheduled for your project.
- Milestone payments (for example, a payment due when a design is approved) are non-refundable once that stage has been delivered.
- Hosting is billed monthly and you can cancel anytime with 30 days’ notice. We don’t refund partial months.
- Disagreements about a charge: please contact us first at disputes@foundry27.app before disputing it with your bank or card issuer. We’ll work it out with you.
Your part
You provide your content (text, photos, logos, pricing), timely feedback, and any accounts the project needs in your name — for example your domain, and your own Stripe or Square account for taking payments. You confirm you have the right to use everything you give us.
Who owns what
- You own your content, your branding, and your data, always.
- Once your project is paid in full, you own the work we created specifically for you, and you receive a permanent license to use our underlying software framework as part of your site — including running it yourself on your own server.
- We keep ownership of our reusable framework, tools and templates, and may use them for other clients. We won’t reuse your content or branding.
- We may show your finished site in our portfolio unless you ask us not to.
Hosting
- Hosting is billed monthly and continues until either of us cancels.
- Either of us can cancel with 30 days’ notice. When hosting ends, we’ll give you a copy of your site’s code and data so you can move it elsewhere.
- We keep your site updated and backed up nightly and work to keep it online, but we can’t promise uninterrupted service — outages at our providers and scheduled maintenance happen.
Payments your customers make
If your site takes payments, the money goes directly to your own payment processor account. We never hold your funds. Your processor’s terms and fees apply to those payments.
Warranty
We’ll fix bugs in the work we delivered that you report within 30 days of launch, free of charge. Beyond that, our services are provided “as is,” and we don’t guarantee any particular business results.
Limitation of liability
To the extent the law allows, our total liability for any claim relating to our services is limited to the amount you paid us in the 12 months before the claim, and we aren’t liable for lost profits or other indirect damages.
Governing law
These terms are governed by the laws of the State of Michigan. If a dispute comes up, email disputes@foundry27.app and we’ll first try to resolve it directly and in good faith.
Changes
We may update these terms; the effective date above shows the latest version. Changes don’t affect a project already underway under an accepted quote.
